It is completely legal in all 50 states to use a hidden camera. However, it is illegal to record speech without a person’s consent in the following 15 states: California, Connecticut, Delaware, Florida, Hawaii, Illinois, Louisiana, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington. There is always the possibility that it won’t be admissible in court. Also, most people are not aware that nanny cameras can’t be placed just anywhere. Just because it is your house doesn’t mean that you can record somebody hired to work there. A nanny has the right to privacy in a bathroom and a bedroom if an overnight stay is required. Violation of these rights could find you on the wrong end of a lawsuit. Another legal fact: There are currently no Federal laws that state you have to provide any information about your taping, recording or using a “Nanny Cam” in your own household.
